Update to O’ahu Owners regarding 30-Day vs. 90-Day Minimum Rental Period

To our valued homeowners,

 

We know many of our O’ahu owners have been concerned about the legislative position for 30-day rentals and whether 90-day minimums could or would be enforced starting this September. We wrote about this in our July Owner Newsletter and are providing you here with a further update, which we hope will reassure and clarify. 

 

We have worked with O’ahu Short-Term Rental Alliance (OSTRA) and their legal counsel to review our understanding that 90-day minimum rental periods remain unenforceable by the City and County of Honolulu (the City). You can read here OSTRA’s Statement Regarding 90 versus 30 Day Minimum published earlier this month. 

 

In summary, OSTRA states that while recent legislation technically maintains a 90-day minimum rental period on paper, a federal court's permanent injunction prohibits the City from enforcing this requirement retroactively against short-term rentals (STRs) that were legally operating under the 30-day minimum prior to its enactment. The City’s Department of Planning and Permitting (DPP) has publicly acknowledged both the legal limitations and practical challenges of enforcing the 90-day rule and has affirmed its continued enforcement of a 30-day minimum stay for STRs. Notably, the following statement can be found on the DPP website: “The Department of Planning and Permitting will continue to enforce STRs as less than 30 consecutive days across the board.” 

 

Given these factors, we are confident that our current approach to mid-term rentals aligns to what DPP has publicly stated. 

 

We hope this provides some clarity among conflicting messages circulating in the community. We will continue to work closely with OSTRA to monitor, and advocate, for homeowners’ interests. Your continued support and membership of OSTRA is critical to these efforts.
